What are the penalties for using a mobile phone whilst driving?

The maximum penalty for Using a Handheld Mobile Phone (whilst driving) is a fine of £1000.00 (£2,500 if you’re driving a lorry or bus) and the endorsement of 6 penalty points (applying to offences committed on or after 1st March 2017).

This will require you to pay a £100.00 penalty and will result in 3 penalty points being endorsed on your driving licence. You should only accept a Fixed Penalty Notice if you accept that you have committed the offence. If you have not committed the offence, then you may reject the Fixed Penalty Notice and request a hearing before the Magistrates’ Court where you will be able to have a trial and put your version of events.

  • Talking on your phone;
  • Sending a text message or reading a received message;
  • Browsing on the internet;
  • Using social media e.g. Facebook or Twitter;
  • Sending or reading a received email; or
  • Using an interactive map.

It is perfectly legal to use your phone as a sat nav. However, you must not touch your phone at any point.

If you are using your phone as a sat nav, it should be securely fixed to your windscreen or dashboard, without restricting your view. You should set up the navigation before you start driving, so that you don’t need to touch your phone whilst driving.

The only time that you can legally use a mobile phone in your car is when you are parked in a safe place with your handbrake applied and your engine switched off. This does not include when you are sat in traffic or queuing at a red traffic light.

The only exception to this law is if you need to make an emergency call and it is not safe to stop your vehicle.

You can use a mobile phone to make a contactless payment if your vehicle is stationary, for example in a drive through restaurant.
